Terms and conditions for Philips Parents’ Day Campaign 2018

1.     The promoter is Philips Electronics Singapore Pte Ltd (CO. REG. NO. 199705989C) of 622 Lorong 1 Toa Payoh Singapore 319763 (“Promoter”).
 

2.     This promotion is valid for all purchases of eligible Philips products (as specified in Clause 3 below) that are made from 1 May 2018 – 31 July 2018 (both dates inclusive) in participating Singapore stores carrying the eligible Philips products. Please check in-store for more information.
 

3.     Redemption requirements and gifts:

(a) With every $199 spend on Philips Male grooming, Oral Health Care and/or Beauty products in a single receipt, and register for product warranty on MyPhilips (https://www.philips.com.sg/myphilips/login.html#tab=register-product), consumer will have one chance to be one of the lucky winners to win an OSIM uPhoria Warm Leg Massager (worth $799).
 

(b)     With every $299 spend on Philips Male grooming, Oral Health Care and/or Beauty products in a single receipt, and register for product warranty on MyPhilips (https://www.philips.com.sg/myphilips/login.html#tab=register-product), consumer will have one chance to be one of the lucky winners to win an OSIM uDiva Classic Massage Sofa (worth $2,599).
 

(c)     There are a total of 30 prizes (20 units of OSIM uPhoria Warm Leg Massager, and 10 units of OSIM uDiva Classic Massage Sofa) with a total worth of SGD41,970.
 

(d)     Customers are required to register/log in to their MyPhilips account at website https://www.philips.com.sg/myphilips/login.html#tab=register-product) and upload their receipts in order to be eligible for the draw.
 

(e)     Winners will be determined by lucky draw. The lucky draw will be conducted on 5 June 2018, 5 July 2018 and 6 August 2018. In each lucky draw, a total of 10 prizes will be given.
 

(f)     All eligible entries will be qualified for the lucky draw in the following manner:

(i) Entries received from 1 May 2018 to 31 May 2018 will be included in the lucky draw conducted on 5 June 2018. Prizes available for this draw are 7 units of OSIM uPhoria Warm Leg Massager and 3 units of OSIM uDiva Classic Massage Sofa;
 

(ii) Entries received from 1 June 2018 to 30 June 2018 will be included in the lucky draw conducted on 5 July 2018. Prizes available for this draw are 7 units of OSIM uPhoria Warm Leg Massager and 3 units of OSIM uDiva Classic Massage Sofa; and
 

(iii) Entries received from 1 July 2018 to 31 July 2018 will be included in the lucky draw conducted on 6 August 2018. Prizes available for this draw are 6 units of OSIM uPhoria Warm Leg Massager and 4 units of OSIM uDiva Classic Massage Sofa.
 

(g) The lucky draw will be conducted using a computerised system.
 

(h) Winners list will be announced on promotion site and social media; and winners will receive a notification letter via email.
 

(i) Winners of the lucky draw can redeem the prizes from 5 June 2018 – 6 September 2018 (both dates inclusive) only at OSIM Headquarters at 65 Ubi Avenue 1, Singapore 408939 by providing the notification letter from the Promoter. No extension request will be granted. Redemption time: Monday – Friday (10am – 5pm). Closed on Saturday, Sunday and Public Holidays.
 

4.     Purchases made at Philips Carnival Sales are not eligible for this promotion.
 

5.     All customers must present their original receipt and original NRIC (“Personal Data”) for the redemption. A copy of your Personal Data will be retained by the Promoter for auditing redemption purposes and you hereby consent to your Personal Data being collected and used for the purpose specified herein. No photocopied or combined receipts are allowed.
 

6.     This promotion is subject to the laws of Singapore, the Personal Data Protection Act 2012 (“PDPA”) and Philips’ Privacy Policy located at: http://www.philips.com.sg/a-w/privacy-notice.html. Philips values and respects your privacy. Please read the Privacy Policy carefully to understand how we may use your data and what some of your rights are. By reading and accepting these terms and conditions in full and by providing your Personal Data at the time of redemption, you consent to Philips collecting, using, disclosing and processing your Personal Data in accordance with the PDPA and Philips’ Privacy Policy.
 

7.     Each customer is only allowed ONE redemption, regardless of the number of single receipts he/she may have, whether from the same retailer or different retailers.
 

8.     Redeemed gifts are not exchangeable for any Philips product or cash. Redeemed gifts may not be resold.
 

9.     Redemption must be made in person. Alternatively, the customer may designate an authorized representative to redeem the gifts on his/her behalf. However, the authorised representative must present the original receipt and his/her original NRIC together with an authorisation letter signed by the customer. No redemption by mail or courier service will be accepted. No reservation of gifts is allowed.
 

10.     All visuals are for illustration purposes only. Philips reserves the right to change the terms and conditions of the promotion without prior notice and such terms and conditions shall be binding retrospectively. Philips also reserves the right, in its sole discretion, to terminate this promotion at any time and for any reason. Philips shall have no liability whatsoever for the foregoing. Philips’ decision in relation to any of the foregoing shall be final and no correspondence shall be entertained in such event.
 

11.     Any dispute shall be determined by Philips in its sole discretion and all decisions made shall be deemed final and conclusive.
 

12.     Gifts are subject to availability in the sole discretion of Philips. Philips reserves the right to substitute a similar product for any advertised gift. Each gift is provided "as is" with no warranty or guarantee by Philips and Philips specifically disclaims any warranty of fitness, merchantability, safety and the like in relation to the gifts. Philips reserves the right, in its sole discretion, to determine that a person is not eligible to receive a gift for any reason, including, but not limited to, suspected fraud or a breach of these terms and conditions. Philips, its employees, agents and/or the Philips authorised participating retailers shall have no liability for any of the foregoing, and/or for any malfunctions, interruptions, failures, delays or difficulties in the course of the promotion or the redemption of the gifts.
 

13.     To the fullest extent permitted by law, you hereby forever release and discharge Philips and its affiliates, officers, directors, employees, agents, licensees, consultants and independent contractors (collectively, “Released Parties”) from any liability whatsoever for any and all accidents, personal injuries and/or other claims arising from or in connection with your participation in the promotion or resulting from the acceptance and/or subsequent use or misuse of any gift including claims that are known or unknown. You agree that you will not now or at any time in the future, directly or indirectly, commence or prosecute any suit against the Released Parties arising out of or relating to the actions, causes of action, and the like hereby expressly waived by you. This provision is binding on you, your spouse, your children, legal representatives, heirs, successors and assigns. By participating in the promotion, you agree to defend and hold harmless Philips against any demands, claims or actions arising out of or as a result of or in connection with your participation in the promotion, your breach or violation of our terms and conditions, including any breach arising from violations of law and regulation, as well as claims of infringement, misappropriation or violation of the rights of any person or entity ("Claim") and you shall indemnify and hold Philips harmless from and against any and all losses, damages, costs and expenses, including attorneys’ fees, resulting from any such Claim. We have the right, at any time, to assume the defense against any Claim and all negotiations for settlement and compromise and you agree to cooperate with us in any such defense. OUR LIABILITY TO YOU IS LIMITED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR LOSS, DAMAGE, COST AND/OR EXPENSE OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORM OF ACTION OR BASIS OF THE CLAIM AND WHETHER OR NOT A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES) IN

CONNECTION WITH OR ARISING FROM THE PROMOTION, ANY OTHER MATERIALS WE PROVIDE TO YOU AND/OR YOUR PARTICIPATION OR INABILITY TO PARTICIPATE IN THE PROMOTION. IF ANY LIMITATION OR EXCLUSION OF DAMAGES OR LIABILITY IS PROHIBITED OR RESTRICTED BY LAW, WE SHALL BE ENTITLED TO THE MAXIMUM LIMITATIONS AND EXCLUSIONS PERMITTED; HOWEVER, IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED SINGAPORE DOLLARS (S$100).
