Terms and conditions for Philips World Oral Health Day Campaign

  1. The promoter is Philips Electronics Singapore Pte Ltd (CO. REG. NO. 199705989C) of 622 Lorong 1 Toa Payoh Singapore 319763 (“Promoter”).
  2. Scope of promotion:
    1. This promotion is valid for purchases of Sonicare Electric Toothbrushes (as defined below) made from 1 March 2018 to 30 April 2018 (both dates inclusive) in Philips’ Consumer Care, Philips’ online shop and participating online and offline stores that are authorised by Promoter to sell Philips products in Singapore (collectively, “Participating Stores”).
    2. Eligible Sonicare Electric Toothbrushes are defined as:
      • Philips Sonicare DiamondClean Smart Electric Toothbrush HX9224/46,
      • Philips Sonicare DiamondClean Electric Toothbrush (Rose Gold) HX9312/04,
      • Philips Sonicare DiamondClean Electric Toothbrush (Black) HX9352/04 and
      • Philips Sonicare DiamondClean Electric Toothbrush (Pink) HX9362/67.
    3. For every purchase of Sonicare Electric Toothbrush, you will receive one (1) NETS FlashPay Card worth $30 (“NETS Card”). The NETS Card are limited and will be given on first come first serve basis. It is only valid for the first 1,400 redemptions.
  3. Redemption period is from 1 March 2018 – 12 May 2018 (both dates inclusive) during the opening hours of Philips Consumer Care (“CC”) as specified below (“Redemption Period”). No request for extension of the Redemption Period will be entertained. Mon – Fri (9am – 6pm) Sat (9am – 1pm). Closed on Sundays and Public Holidays.
  4. To redeem the NETS Card during the Redemption Period, you must provide the original receipt evidencing the purchase of the Sonicare Electric Toothbrush and your original NRIC (“Personal Data”) to a Promoter’s representative at Philips Consumer Care located at 622 Lorong 1 Toa Payoh Singapore 319763. No photocopied or combined receipts are allowed. A copy of your Personal Data will be retained by the Promoter for auditing redemption purposes.
  5. Each customer is only allowed ONE (1) redemption, regardless of the number of single receipts he/she may have, whether from the same Participating Store or different Participating Stores.
  6. Redemption must be made in person. Alternatively, you may designate an authorized representative to redeem the NETS Card on your behalf. However, your authorised representative must present the original receipt and his/her original NRIC together with an authorisation letter signed by you. No redemption by mail or courier service will be accepted. No reservation of NETS Card is allowed.
  7. This promotion is subject to the laws of Singapore, the Personal Data Protection Act 2012 (“PDPA”) and Promoter’s Privacy Policy located at: www.philips.com.sg/a-w/privacy-notice.html. Promoter values and respects your privacy. Please read the Privacy Policy carefully to understand how Promoter may use your data and what your rights are. By reading and accepting these terms and conditions in full and by providing your Personal Data at the time of redemption, you consent to Promoter collecting, using, disclosing and processing your Personal Data for purposes of this promotion in accordance with the PDPA and Promoter’s Privacy Policy.
  8. The NETS Cards are not exchangeable for any other product or cash.
  9. All visuals are for illustration purposes only. Promoter reserves the right to change, update and/or replace the terms and conditions of the promotion without prior notice and such terms and conditions shall be binding retrospectively. Promoter also reserves the right, in its sole discretion, to terminate this promotion at any time and for any reason. Promoter shall have no liability whatsoever for the foregoing. Promoter’s decision in relation to any of the foregoing shall be final and no correspondence shall be entertained in such event.
  10. Any dispute shall be determined by Promoter in its sole discretion and all decisions made shall be deemed final and conclusive.
  11. The NETS Cards are subject to availability. Philips reserves the right to substitute a similar product for any advertised gift. Each gift is provided “as is” with no warranty or guarantee by Philips and Philips specifically disclaims any warranty of fitness, merchantability, safety and the like in relation to the gifts. Philips reserves the right, in its sole discretion, to determine that a person is not eligible to receive a gift for any reason, including, but not limited to, suspected fraud or a breach of these terms and conditions. Philips, its employees, agents and/or the Philips authorised participating retailers shall have no liability for any of the foregoing, and/or for any malfunctions, interruptions, failures, delays or difficulties in the course of the promotion or the redemption of the gifts.
  12. To the fullest extent permitted by law, you hereby forever release and discharge Promoter and its affiliates, officers, directors, employees, agents, licensees, consultants and independent contractors (collectively, “Released Parties”) from any liability whatsoever for any and all accidents, personal injuries and/or other claims arising from or in connection with your participation in the promotion or resulting from the acceptance and/or subsequent use or misuse of any gift including claims that are known or unknown. You promise that you will not now or at any time in the future, directly or indirectly, commence or prosecute any suit against the Released Parties arising out of or relating to the actions, causes of action, and the like hereby expressly waived by you. This provision is binding on you, your spouse, your children, legal representatives, heirs, successors and assigns. By participating in the promotion, you agree to defend and hold harmless Promoter against any demands, claims or actions arising out of or as a result of or in connection with your participation in the promotion, your breach or violation of our terms and conditions, including any breach arising from violations of law and regulation, as well as claims of infringement, misappropriation or violation of the rights of any person or entity (“Claim”) and you shall indemnify and hold Promoter harmless from and against any and all losses, damages, costs and expenses, including attorneys’ fees, resulting from any such Claim. Promoter shall have the right, at any time, to assume the defense against any Claim and all negotiations for settlement and compromise and you agree to cooperate with Promoter in any such defense. PROMOTER’S LIABILITY TO YOU IS LIMITED. TO THE FULLEST EXTENT PERMITTED BY LAW, PROMOTER DISCLAIMS ALL LIABILITIES FOR LOSS, DAMAGE, COST AND/OR EXPENSE OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORM OF ACTION OR BASIS OF THE CLAIM AND WHETHER OR NOT A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES) IN CONNECTION WITH OR ARISING FROM THE PROMOTION, ANY OTHER MATERIALS PROMOTER PROVIDES TO YOU AND/OR YOUR PARTICIPATION OR INABILITY TO PARTICIPATE IN THE PROMOTION. IF ANY LIMITATION OR EXCLUSION OF DAMAGES OR LIABILITY IS PROHIBITED OR RESTRICTED BY LAW, PROMOTER SHALL BE ENTITLED TO THE MAXIMUM LIMITATIONS AND EXCLUSIONS PERMITTED; HOWEVER, IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED SINGAPORE DOLLARS (S$100).
